I'm glad others are also considering agency and intention in the definition of art. I'm an ML developer with a background in fine arts, so this topic is of particular interest to me.
Modern ML "art" generators usually study existing art, then interpolate within those distributions to produce new works based on patterns they see. So A.I. art is still only a mirror held up to human-made art.
Creating art is an intentional social action. I don't think we'll have better options than the above until A.I. can engage in the social sphere, with intent and agency.
